- Definitions
1.1 “Company” means Fairway Mortgage Solutions, registered in England and Wales under company number 15937339, with its registered office at 23 High Street, Royston, England, SG8 9AA.
1.2 “Referral Scheme” means the kit referral promotion operated by the Company.
1.3 “Referrer” means any individual who refers a third party to the Company in accordance with these Terms and Conditions.
1.4 “Referred Client” means the individual introduced to the Company by the Referrer.
1.5 “Qualifying Mortgage” means a mortgage application submitted through the Company that completes successfully and generates a procuration fee payable to the Company.
1.6 “Reward” means the free sports kit provided under this Referral Scheme.
- Eligibility
2.1 The Referral Scheme is open to members of the general public aged 18 or over and resident in the United Kingdom.
2.2 Employees, agents, and contractors of the Company may not be eligible to participate, at the Company’s discretion.
2.3 Referrals must be made in good faith and must not breach any applicable law, regulation, or professional rule.
- How the Referral Scheme Works
3.1 The Referrer may refer a Referred Client to the Company by any available method of contact
3.2 The Referrer must obtain the Referred Client’s consent before providing their personal data to the Company.
3.3 A referral will only be deemed valid where the Referred Client is not already known to the Company or engaged in an active application process.
- Reward Conditions
4.1 The Reward will only be issued once:
(a) the second Referred Client completes a Qualifying Mortgage or Insurance policy; and
(b) the Company has received its procuration fee in full.
4.2 The Reward is non-transferable, non-exchangeable, and has no cash alternative.
4.3 The Company reserves the right to substitute the Reward with an alternative of equal or greater value if necessary.
4.4 The company reserves the right to impose a maximum value on the sports kit
- Sports Kit Details
5.1 The sports kit will be supplied by a third-party provider selected by the Company.
5.2 Kit specifications, sizes, colours, branding, and delivery times are subject to availability.
5.3 The Company accepts no responsibility for manufacturing defects, sizing issues, or delays caused by the third-party supplier.
- Data Protection
6.1 Personal data will be processed in accordance with the UK GDPR and the Data Protection Act 2018.
6.2 Details of how personal data is used can be found in the Company’s Privacy Policy.
6.3 The Referrer confirms they have obtained all necessary consents before sharing any personal data.
- Misuse and Disqualification
7.1 The Company reserves the right to withhold or withdraw the Reward where it reasonably believes:
(a) false or misleading information has been provided;
(b) the Referral Scheme has been abused; or
(c) these Terms and Conditions have been breached.
7.2 The Company’s decision in such matters shall be final.
- Changes and Termination
8.1 The Company reserves the right to amend, suspend, or withdraw the Referral Scheme at any time without prior notice.
8.2 Any referrals submitted prior to termination will be honoured in accordance with these Terms and Conditions, unless stated otherwise.
- Liability
9.1 Nothing in these Terms and Conditions shall exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
9.2 Subject to clause 9.1, the Company shall not be liable for any indirect or consequential loss arising from participation in the Referral Scheme.
- Governing Law
10.1 These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
10.2 The courts of England and Wales shall have exclusive jurisdiction.
